These Terms & Conditions govern your use of staygoldenathletics.com and any purchase you make from Stay Golden Athletics, a brand operated by Stay Golden Brands, Inc. By using the site or placing an order, you agree to these Terms.
1. Eligibility
You must be at least 18 years old and located in the United States to purchase from us. By ordering, you confirm that you meet these requirements.
2. Products and preorders
- Product images, colors, and descriptions are provided as accurately as possible; some color names shown are placeholders and final colorways, finishes, and specifications may vary slightly.
- Preorders reserve products that are still in production, with estimated delivery in February–March 2027 and a 500-unit-per-size production minimum. Our Refund, Returns & Preorder Policy is part of these Terms and describes your refund and cancellation rights, including a full refund if a size does not reach production.
3. Orders and acceptance
Your order is an offer to buy. We may accept, decline, limit, or cancel any order — for example, in cases of suspected fraud, pricing or listing errors, or quantity limits. If we cancel an order you’ve paid for, we’ll refund the amount paid.
4. Pricing and payment
- Prices are in U.S. dollars and may change over time; the price shown at checkout applies to your order. Applicable sales tax is added at checkout.
- Payments are processed securely by Stripe. You authorize us and Stripe to charge your selected payment method for your order (and, where a deposit is offered, for the remaining balance before shipping).
- Promotional and creator discount codes are limited to one per customer unless stated otherwise, have no cash value, cannot be applied retroactively, and may be modified or withdrawn at any time.
5. Shipping
We ship within the United States only. Title and risk of loss pass to you when the carrier receives the shipment. Delivery timing is estimated and not guaranteed.
6. Intellectual property
The Stay Golden Athletics name, the Play Golden tagline, our logos, product designs, text, graphics, and other site content are owned by us or our licensors and are protected by trademark, copyright, and other laws. Design-patent protection is pending on elements of the Game Day Backpack, including its ventilated cleat compartment, internal flag-tube pocket, and female-contoured strap system. You may not copy, reproduce, or use our brand or content without our prior written permission.
7. Your submissions
If you post about us or tag us on social media, or send us feedback or ideas, you grant Stay Golden Athletics a non-exclusive, royalty-free license to use, display, and repost that content in connection with our brand, with credit where practical. You are responsible for content you submit.
8. Acceptable use
You agree not to misuse the site, including by attempting to disrupt it, access it without authorization, infringe others’ rights, or use it for any unlawful purpose.
9. Disclaimers
The site and products are provided as is and as available. To the fullest extent permitted by law, we disclaim all warranties not expressly stated, including implied warranties of merchantability and fitness for a particular purpose. Nothing in these Terms limits any warranty or right that cannot be excluded under applicable law.
10. Limitation of liability
To the fullest extent permitted by law, Stay Golden Athletics and Stay Golden Brands, Inc. will not be liable for indirect, incidental, special, or consequential damages, and our total liability for any claim relating to a product or order will not exceed the amount you paid for that order. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
11. Indemnification
You agree to indemnify and hold harmless Stay Golden Athletics and Stay Golden Brands, Inc. from claims arising out of your misuse of the site or violation of these Terms.
12. Governing law and disputes
These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. You agree that disputes will be resolved in the state or federal courts located in California, unless applicable law provides otherwise.
13. Changes to these Terms
We may update these Terms from time to time. The version in effect when you place an order governs that order, and continued use of the site means you accept the current Terms.
14. Miscellaneous
If any provision is found unenforceable, the rest remains in effect. These Terms, together with our Privacy Policy and Refund, Returns & Preorder Policy, are the entire agreement between you and us regarding the site and your orders.
